Terms of Service

These Terms of Service ("Terms") govern your access to and use of MyTripMatch (the "Platform", "we", "us"). By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Eligibility

You must be at least 18 years old to create an account and use the Platform. By registering, you confirm that you meet this requirement and that the information you provide is accurate.

2. Account Registration and Terms Acceptance

When you create an account, you will be asked to accept these Terms and our Privacy Policy. Your acceptance is recorded with a timestamp and the version of the Terms in effect at that time. This record is stored in our database for legal compliance purposes and to facilitate our mobile app launch. If we make material changes to these Terms, we will re-prompt you to accept the updated version before you continue using the Platform.

3. Nature of Our Service

MyTripMatch is a technology platform that:

• Generates AI-assisted travel itineraries based on publicly available and AI-synthesised information
• Facilitates connections between users and independent third-party travel agent partners
• Displays tour packages created and owned entirely by those independent agent partners

We are not a travel agency, tour operator, or booking platform. We do not organise, operate, or guarantee any trip, tour package, accommodation, or transportation. Any booking or payment for a tour package is made directly between you and the relevant agent partner under that agent's own terms.

4. AI-Generated Content Disclaimer

Itineraries, place descriptions, cost estimates, and recommendations are generated using artificial intelligence and may contain inaccuracies, outdated information, or errors. Always verify critical details — including visa requirements, opening hours, prices, and safety conditions — through official sources before making travel decisions. We are not liable for losses arising from reliance on AI-generated content.

5. User Accounts

• You are responsible for keeping your login credentials confidential
• You are liable for all activity that occurs under your account
• You must notify us immediately of any unauthorised access to your account
• We reserve the right to suspend or terminate accounts that violate these Terms
• You may delete your account at any time from your Profile page. Deleted accounts cannot be recovered and the associated email address cannot be used to create a new account (to prevent free-trial abuse)
• When you save (wishlist) a tour package, the agent partner who listed it is told that it was saved. Your name and email are shared with agent partners on Premium only if you choose to share them; you are asked the first time you save a package and can change your choice at any time from your Profile page (see our Privacy Policy, Section 1.4a)

6. Subscription Plans

6.1 User Pro Plan

Free accounts are limited to a set number of AI trip generations per month. The Pro Plan removes this limit for ₹149/month, billed via Razorpay's recurring subscription system. Your subscription automatically renews every 30 days by charging your authorised payment method (UPI Autopay or saved card) until you cancel. You may cancel auto-renewal at any time from your Profile page — access continues until the end of your current billing period, after which no further charge is made. If you delete your account, your active Razorpay subscription is cancelled immediately and you will not be charged again.

6.2 Agent Partners — Free Plan and Premium

Free for every agent partner: publishing and editing an unlimited number of tour packages, receiving and answering traveller enquiries and trip requests, and applying for blue-tick verification. The blue tick is granted after a review by MyTripMatch and may be declined or withdrawn if the information provided cannot be verified or these Terms are breached.

Premium (₹299/month): engagement analytics, demand gaps, saved leads (see Section 7) and priority placement, meaning Premium partners' packages are ranked higher in traveller search results. Free-plan packages remain listed, ranked below Premium ones. New agent partners receive Premium free for their first month; no payment details are required for this. Premium auto-renews monthly via Razorpay and can be cancelled at any time from the agent dashboard. When a free month or a paid period ends without renewal, the account moves to the free plan: packages stay live and only the Premium features stop. If an agent account is deleted, any active subscription is cancelled immediately.

Not paying never removes listings or enquiries. MyTripMatch may, however, restrict or lock an agent account — including its listings and enquiries — for breach of these Terms (Sections 7 and 14).

6.3 Taxes and Invoices

Subscription prices are inclusive of GST. For each payment, a GST tax invoice issued by MyTripMatch can be downloaded from your billing history (Profile page for the Pro Plan; agent dashboard for Premium), and a payment receipt is emailed to you. Razorpay processes the payment but does not send separate invoices for these subscriptions. An invoice, once issued, is not changed; if a payment is refunded, the refund is noted against that invoice.

Agent partners registered for GST may add their GSTIN, legal name and registered address in the agent dashboard so that it appears on their invoices. By doing so you confirm that the details are accurate and belong to your business. Invoices use the details on record when they are issued.

7. Agent Partner Obligations

By registering as an agent partner, you agree to:

• Provide accurate, honest, and up-to-date descriptions of tour packages and pricing
• Honour the stated terms of any package a customer books based on your listing
• Respond to customer enquiries in good faith and within a reasonable time
• Comply with all applicable Indian laws, including the Consumer Protection Act, 2019, the Digital Personal Data Protection Act, 2023, and any central or state rules that apply to travel and tourism businesses
• Not publish false, misleading, or fraudulent listings
• Not use the Platform to solicit payments outside the Platform's advertised terms
• Provide genuine information when applying for blue-tick verification
• Use traveller details you receive through the Platform — including the names and email addresses shown under Saved Leads (only for travellers who chose to share them) and the trip details in trip requests — only to respond to that traveller's interest in your packages; never sell, share, or add them to unrelated marketing lists, and stop contacting a traveller who asks you to or who withdraws their consent
• Provide accurate GST details if you add them for your invoices, and keep them up to date

We reserve the right to remove listings, suspend, or permanently ban any agent account that violates these obligations.

8. Trip Buddy — User Posts and Direct Messaging

Trip Buddy lets you post that you're planning a trip and connect directly with other users who want to join or share the journey. This section applies specifically to that feature.

8.1 We Do Not Vet Users

We do not conduct background checks, identity verification, or any form of vetting on users who post or respond to Trip Buddy posts. We cannot and do not guarantee the identity, intentions, trustworthiness, or safety of any user you connect with through this feature. Any decision to communicate with, meet, or travel with another user is made entirely at your own discretion and risk.

8.2 Safety Recommendations

We strongly encourage you to:

• Communicate within the Platform initially, rather than immediately sharing personal contact details
• Avoid sharing sensitive information (home address, financial details, travel documents) until you're confident in who you're speaking with
• Meet in a public place for the first time before committing to travel together, if meeting in person before the trip is practical
• Trust your judgement — if something feels wrong, disengage and use the report or block feature
• Independently verify anything a prospective travel companion tells you about themselves before making financial commitments together

8.3 Prohibited Conduct on Trip Buddy

In addition to Section 9 below, when using Trip Buddy you agree not to:

• Post fake, misleading, or bait-and-switch trip plans
• Use the feature to solicit money, deposits, or payments from other users outside of a genuine, mutually agreed travel arrangement
• Harass, threaten, or send unwelcome or inappropriate messages to other users
• Use contact information obtained through Trip Buddy for unrelated commercial solicitation or spam
• Create multiple accounts to evade a block or a ban resulting from a report

8.4 Reporting and Moderation

You can report a post or block another user at any time from within the feature. We review reports and may, at our sole discretion, remove content, suspend, or permanently ban accounts found to violate these Terms. We are not obligated to take any specific action on a report, and we do not guarantee that reviewing a report will happen within any particular timeframe. Blocking a user is one-directional and immediate — it does not notify the blocked user.

8.5 No Liability for User-to-User Interactions

MyTripMatch is not a party to any arrangement, trip, or agreement made between users through Trip Buddy. We are not liable for any loss, injury, dispute, financial harm, or damage arising from your interactions, communications, or travel with another user you connected with through this feature, whether or not we were notified of a report involving that user beforehand.

9. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of Indian law
• Attempt to gain unauthorised access to our systems, servers, databases, or other users' accounts
• Delete and re-register an account to exploit free trials or free-tier limits — this is explicitly prohibited and technically enforced
• Access our backend API directly using automated tools, scripts, bots, scrapers, or any method other than our official website or mobile app
• Attempt to bypass, disable, or circumvent any security, rate-limiting, or access-control mechanism on the Platform
• Conduct security testing, penetration testing, or vulnerability scanning on the Platform without prior written permission from us
• Scrape, copy, or republish AI-generated content for commercial purposes without written permission
• Impersonate any person or entity or misrepresent your affiliation with any entity
• Upload malicious code, unsolicited messages (spam), or content that infringes third-party intellectual property rights
• Use the Platform in any way that could damage, disable, or impair its performance or availability

10. Security and API Access

Our backend API is a private service designed exclusively for use through our official website (www.mytripmatch.in) and our official mobile app (when launched). In production, direct access to our API from third-party tools, scripts, or applications is technically restricted and not permitted under these Terms.

If you discover a security vulnerability in the Platform, we encourage responsible disclosure. Please report it to privacy@mytripmatch.inrather than exploiting or disclosing it publicly. We will investigate all reports and respond within 7 business days.

11. Payments and Refunds

All payments are processed securely through Razorpay. Please refer to our Refund & Cancellation Policy for details on cancellations and refunds. Payments made directly to agent partners are governed by that agent's own cancellation terms. Trip Buddy is a free feature — MyTripMatch does not process, hold, or have any involvement in any payment arrangement you make directly with another user.

12. Limitation of Liability

To the maximum extent permitted by Indian law, MyTripMatch shall not be liable for any indirect, incidental, special, or consequential damages, including losses related to travel bookings made with third-party agent partners, inaccuracies in AI-generated itineraries, interactions or arrangements made with other users through Trip Buddy, or service interruptions.

13. Intellectual Property

The MyTripMatch Platform — including its design, branding, software, and AI-generated itinerary structure — is owned by MyTripMatch. Content uploaded by agent partners (package descriptions, images) remains the property of that agent, who grants MyTripMatch a non-exclusive, royalty-free licence to display it on the Platform. Content you post on Trip Buddy (your posts and comments) remains yours, but by posting it you grant MyTripMatch a non-exclusive, royalty-free licence to display it to other users on the Platform for as long as your post remains active or as otherwise described in our Privacy Policy's retention terms.

14. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct we believe violates these Terms or is harmful to other users, agents, or the Platform. Upon termination, your right to use the Platform ceases immediately.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in India. We encourage you to contact us first at support@mytripmatch.in to resolve any issues before pursuing legal proceedings.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and prompt you to re-accept the updated Terms on your next login. Continued use of the Platform after the effective date of a change constitutes acceptance.
